Terms of service

Publisher: Pi-Com Sàrl (hereinafter “Pi-Com”, “the Publisher” or “we”). Product: Workin (hereinafter “the Service” or “the Application”).

Article 1 — Purpose and scope

1.1. These Terms of Service (the “Terms”) govern access to and use of the Workin web application, published by Pi-Com Sàrl, a limited liability company under Swiss law, with its registered office at Rue de Lausanne 22, 1030 Bussigny (Switzerland), registered in the commercial register under business identification number IDE CHE-490.271.650.

1.2. The Service is accessible at https://app.workin.app. The marketing website is accessible at https://workin.app.

1.3. Workin is a progressive web application (PWA) for working-time tracking and human resources management intended for small and medium-sized enterprises (SMEs). The Service is provided in a strictly professional (B2B) context: it is aimed exclusively at companies, organizations and professionals acting within their business activity, to the exclusion of consumers.

1.4. Use of the Service entails full and unreserved acceptance of these Terms, the Privacy Policy and, where applicable, the Data Processing Agreement (DPA).

Article 2 — Definitions

Article 3 — Description of the Service

3.1. Workin offers, in particular: time tracking (timer, multiple sessions, manual entry, time-stamped timeline); optional geolocation at clock-in (which can be enabled/disabled by the company and by each user); hours management (balances, overtime, legal breaks, contractual targets); leave and absence management (approval workflow, supporting documents, team calendar); reporting (reports, charts, PDF/Excel exports); multi-company administration and an optional “manager” role; monthly locking of timesheets; email notifications; multi-language support and a light/dark theme; partial offline operation (PWA).

3.2. The detail of the features is documented in the in-app help and may evolve (see Article 12).

3.3. The Service is provided as is (“as is”), in SaaS mode, accessible via a browser. The Client receives no copy of the software and acquires no ownership rights in it.

Article 4 — Account creation and access

4.1. Registration. Creating a company space is done via the /register page. An isolated data space is created automatically with a WK-XXXXXX reference.

4.2. Email verification. Access to company data requires prior verification of the email address.

4.3. User accounts. The Administrator can create accounts for their employees (entry or Excel import, up to 200 per batch). Each employee receives an invitation by email.

4.4. Credential security. The Client and each User are solely responsible for the confidentiality of their credentials. Any action performed from an account is deemed to have been performed by its holder. The Client undertakes to notify any unauthorized use without delay.

4.5. Accuracy of information. The Client warrants the accuracy and updating of the information provided.

Article 5 — Subscription, payment and billing

5.1. Free account. Certain features (time tracking, history, leave for a single administrator) remain free. The subscription unlocks team management and the advanced options (geolocation, manager role, team calendar, overtime, advanced reports).

5.2. Plans. The Service is offered in two ranges, Starter and Pro, in three headcount tiers. Indicative monthly prices:

The amounts are expressed excluding tax (excl. tax); the applicable VAT (in particular Swiss VAT, calculated where applicable via Stripe Tax according to the Client's country) is added. The same figure applies regardless of currency (CHF / EUR / GBP / USD), selected automatically by country.

5.3. Annual billing. Annual billing is offered with a 17% discount (equivalent to ten monthly payments for the year).

5.4. Founders Offer. A “Founders” offer grants a 33% discount during the first year of subscription, limited to the first 50 subscribing companies. Long-standing clients may benefit from the Pro plan free, with no time limit.

5.5. Trial period. A 30-day trial period is offered. A valid payment card is required upon registration; the first charge occurs at the end of the 30 days, unless cancelled before that term. No new trial is granted in the event of re-subscription after cancellation.

5.6. Payment provider. Payments are processed by Stripe (Stripe Payments Europe, Ltd., Ireland, and/or Stripe, Inc., United States). Pi-Com stores no complete payment card data.

5.7. Plan change. The Client may change plan during the subscription: an upgrade is billed immediately on a pro rata basis, a downgrade generates a credit. The downgrade is refused if the headcount exceeds the limit of the target plan.

5.8. Headcount limit. The number of employees billed may not exceed the limit of the subscribed plan; this limit is enforced technically.

5.9. Cancellation. The Client may cancel at any time, with no commitment, via the management portal. Cancellation takes effect at the end of the current billing period, with access to paid features maintained until that term.

5.10. Refund. As this is a B2B service, no pro rata refund is due for the current billing period already begun, except in the event of prolonged unavailability of the Service attributable to Pi-Com or a mandatory provision applicable to the Client.

5.11. Payment failure. In the event of a payment failure, reminders (dunning) are carried out via Stripe. Failing settlement within a 30-day grace period, the subscription is set to “unpaid” status and access to paid features may be suspended.

Article 6 — Client's obligations and commitments

6.1. The Client undertakes to use the Service in accordance with these Terms, applicable laws and the rights of third parties.

6.2. The Client is the controller of its employees' personal data. As such, it is for the Client in particular: to have a valid legal basis (time tracking, leave, geolocation, medical certificates); to inform its employees and respect their rights; to obtain, where applicable, the required consents (in particular geolocation, which can be disabled by each employee); to comply with the applicable labor law (working time, breaks, rest, health data).

6.3. The Client undertakes in particular not to: attempt to access other companies' data or circumvent multi-tenant isolation; carry out any unauthorized reverse engineering or mass extraction; introduce illegal content or malware; resell or sublicense the Service outside the intended framework.

6.4. The Client indemnifies Pi-Com against any third-party claim (employees, authorities) resulting from a breach of its obligations as controller.

Article 7 — Intellectual property

7.1. The Service, its source code, its interfaces, its visual identity, its trademarks (“Workin”, “Pi-Com”), logos and documentation are the exclusive property of Pi-Com Sàrl or its licensors, protected by intellectual property law.

7.2. These Terms grant the Client a personal, non-exclusive, non-transferable and non-assignable right of use of the Service, for the duration of the subscription and within the limit of the subscribed features.

7.3. Client data. The Client retains full ownership of its Client data and grants Pi-Com a limited license to host, process and display it solely to the extent necessary to provide the Service.

7.4. The Service integrates third-party components (open source and external services) subject to their own licenses.

Article 8 — Availability, maintenance and service level

8.1. Pi-Com implements reasonable means to ensure the availability of the Service, hosted on Google Firebase / Google Cloud infrastructure (European regions).

8.2. No quantified service level agreement (SLA) is guaranteed. The Service is provided “as is”, without warranty of uninterrupted availability, with Pi-Com nevertheless striving to ensure high availability.

8.3. Pi-Com may temporarily interrupt the Service for maintenance, updates or security, limiting the impact and, where possible, informing the Client in advance.

8.4. Pi-Com is not responsible for unavailability attributable to external causes (host, networks, force majeure, act of the Client or a third party), nor for interruptions of third-party providers (Google Firebase, Stripe, Resend, Sentry).

Article 9 — Personal data and confidentiality

9.1. The processing of personal data is described in the Privacy Policy and, for employee data, in the Data Processing Agreement (DPA), which form an integral part of these Terms.

9.2. Pi-Com acts as a processor for employee data processed on behalf of Client companies, and as a controller for the account management data of administrators and the marketing website.

9.3. Each party respects the confidentiality of the non-public information exchanged within the contractual relationship.

Article 10 — Warranties and limitation of liability

10.1. Warranties. The Service is provided “as is”. Pi-Com does not warrant that it is free of errors or suited to a particular need. The Client is solely responsible for the accuracy of the data entered and for the interpretation of the calculations and reports produced (in particular with regard to labor law). The “Legal frameworks by country” information provided in the Application is purely indicative and does not constitute legal advice.

10.2. Limitation. To the maximum extent permitted by applicable law, Pi-Com's liability is limited to direct and foreseeable damages, excluding indirect damages (loss of revenue, loss of operations, harm to image).

10.3. Cap. Pi-Com's total liability is limited to the total amount of the sums paid by the Client during the 12 months preceding the event giving rise to the damage.

10.4. No provision herein limits Pi-Com's liability in the event of willful misconduct or gross negligence (art. 100 CO), nor in cases where the law prohibits it.

Article 11 — Suspension and termination by Pi-Com

11.1. Pi-Com may suspend or terminate access, after formal notice that has remained without effect where circumstances permit, in the event of a serious breach by the Client (payment default, illegal use, security breach).

11.2. Fate of data at the end of the contract. Upon termination of the subscription, the Client may export its data (PDF/Excel exports, GDPR export in JSON format). The data remains recoverable for 30 days after cancellation, then is deleted, subject to legal retention periods. The deletion of a company space results in the irreversible deletion of all associated data, including medical certificates.

Article 12 — Modification of the Terms and the Service

12.1. Pi-Com may modify these Terms, in particular to take account of legal, technical or commercial developments.

12.2. The Client is informed of any substantial modification (notification in the Application and/or by email) with 30 days' notice. Continued use after entry into force constitutes acceptance; failing that, the Client may cancel.

12.3. Pi-Com may evolve the features of the Service, taking care not to substantially degrade it.

Article 13 — Miscellaneous

13.1. Severability of clauses. If a clause is deemed void, the others remain in force.

13.2. Assignment. The Client may not assign its rights without Pi-Com's written consent. Pi-Com may assign the contract as part of a reorganization, guaranteeing the maintenance of its commitments.

13.3. Entire agreement. These Terms, the Privacy Policy and, where applicable, the DPA constitute the entire agreement.

13.4. Language. In the event of a discrepancy between translated versions, the French version prevails.

Article 14 — Governing law and jurisdiction

14.1. These Terms are governed by Swiss law, to the exclusion of conflict-of-law rules and the CISG.

14.2. Jurisdiction. Any dispute falls within the exclusive jurisdiction of the competent courts of the Canton of Vaud (Switzerland), the registered office of Pi-Com Sàrl, subject to mandatory provisions protecting clients established in the European Union.

14.3. European Union clients. The mandatory provisions of applicable local law and of the GDPR remain reserved.
